
Policy Details - Military Childcare
General Aggregate/Each Occurrence- $1,000,000.00/$500,000.00
Commercial General Liability basically means that the Insurance Company's attorneys will defend the provider and anyone the provider is legally responsible for (i.e. certified backup provider, spouse, volunteer) in the event they are served with Notice of Suit, and/or pay out damages due to "Bodily Injury" or "Property Damage" that the provider is legally obligated to pay.
Products/Completed/Ops- Included
Insurance Company will defend and/or pay out damages the provider is legally obligated to pay due to Bodily Injury arising out of improperly administered food or medicines.
Personal Injury- $500,000.00
Insurance Company will defend and/or pay out damages the provider is legally obligated to pay due to damages arising out of Libel or Slander.
Fire Damage Limit- $50,000.00
This coverage protects an insured against claims of a building owner if the insured's negligence causes or contributes to a fire that damages real property.
Medical Expense- $1,000.00
Limit Per Person with a zero Deductible. The Insurance Company will pay medical expenses for "Bodily Injury" caused by an accident both on and off the insured's premises. The accident must take place in the "coverage territory" and during the policy period. This coverage does not extend to the provider, substitute providers, or anyone other than the daycare children. Excess coverage is applicable to non-military dependent children.
Professional Each Claim/Aggregate- $500,000.00/$1,000,000.00
Insurance Company will defend and/or pay out damages the provider is legally responsible for due to any negligent act, error or omission in rendering or failure to render professional day care services.
Abuse or Molestation Each Claim/Aggregate- $100,000.00
Insurance Company will defend and/or pay out damages the provider is legally responsible for due to injury to any person arising out of Sexual and/or Physical Abuse. The Insurance Company has a duty to investigate and defend only up to the point that the provider is found to be guilty of the alleged abuse. If it is determined that the provider is actually guilty of a criminal act, all coverage stops at the point.
Additional Insured
The Military Branch is named on the Insurance Policy as an Additional Insured. Meaning that if the provider is sued, and the Military Branch is named in the lawsuit as a co-defendant, the Insurance Company is obligated to pick up the defense costs to represent the Branch.
Provisions
- Insurance Policy covers the Insured up to a maximum of 6 children on premise at one time.
- Coverage extends on and off the Insured's premises at field trip sites, but not while they are in the car to and from a field trip site.
- Insurance Policy extends coverage to on base housing and off base housing (except when overseas).
- Provider must be certified to provide care. If certification is revoked or expires, all coverage stops.
- If the provider knowingly violates their certification provisions, the Insurance Company's duty to defend and pay out damages ceases.
- Duties of the provider in the event of an Occurrence, Offense, Claim or Suit: Morgan & Associates, Inc. must be notified immediately of any occurrence which may result in a claim.
- Coverage is either in force or not. Policies can not be suspended or put on hold.
- There is absolutely no grace period. Coverage starts and stops at 12:01a.m.
- Certificates can be kept in force and transferred with a simple address change should the provider receive PCS orders.
Minimum Earned Premium vs. Fully Earned Premium
The annual policy is refundable on a pro-rated basis if canceled early, subject to a minimum earned premium of $39.00. Meaning that even if coverage is in force for only one day, the Insurance Company will keep at least the minimum premium and refund the balance.
The six-month policy is fully earned. Meaning that if the policy is canceled at any time before the full six months are up, the Insurance Company is going to keep the entire premium. There are no exceptions to this rule.
Exclusions
CRIMINAL ACTS, CANINE, ASBESTOS, NUCLEAR ENERGY, PERSONAL AUTO TRANSPORTATION, EMPLOYMENT RELATED PRACTICES, CONTRACTUAL LIABILITY, DAMAGE TO PROVIDERS PERSONAL PROPERTY DONE BY DAY CARE CHILDREN (INCLUDING GOVERNMENT OWNED PROPERTY), ANYTHING THAT IS CONSIDERED NON-DAYCARE BUSINESS RELATED.
